Terms & Conditions
1. Making the Booking
Any contract for the supply of our DJ service is between you, the Client and DJ4Me.ie. In order to secure your booking you must agree to these terms and conditions, submit your booking form and pay the €100 deposit. Once we receive the above, a confirmation email will be sent and then DJ4Me can provide the service on the required date and at the required venue. A contract for the booking shall come into effect immediately upon receiving the “Confirmation of Booking” email.
2. Booking Fee
The agreed deposit is due at time of booking and is non-refundable. All prices quoted to you are correct at the time of quotation however bookings are taken on a “first come first served” basis so there is no guarantee that the date will still be available when you come to make your booking. Once DJ4Me confirms your booking and takes your booking fee, all other enquiries for your date are refused. The only time the €100 booking fee may be reused is, if you are changing your date (outside the cancellation periods marked below) to a date within 12 months, however, the date must be available by DJ4Me.ie
The following fees shall be payable by the Client in the event of cancellation:
Cancellation by the Client:
I) Cancellation by the Client within 24 hours of the event start time will result in full payment of the event.
II) Cancellation by the Client within 2 weeks of the event date will result in the Client being liable to pay 75% of the remaining Fee to DJ4Me within 7 days of cancellation.
III) Cancellation by the Client within 1 month of the event date will result in the Client being liable to pay 50% of the remaining Fee to DJ4Me within 7 days of cancellation.
Cancellation by DJ4Me:
In the unlikely event that DJ4Me cancels the booking, DJ4Me will inform the Client of the cancellation as soon as possible and shall make all reasonable attempts to find a suitable replacement artist of similar standard and style at no extra cost to the Client. Note; This has never happened but DJ4Me’s guarantee is that they will not leave you without a DJ for your event.
4. Changes on the day
I) Where possible, changes to the booking which are unavoidable on the day of the event should first be discussed and agreed with the Colm prior to the performance. Any changes agreed will be subject to these Terms and Conditions. Changes negotiated between the Client and the DJ on the day of the event and any extra fees agreed with the Client must be paid by the Client along with the remaining balance of the Booking Fee.
II) Any extra time performed by DJ4Me will result in a €75 per hour charge. This must be paid in cash by the Client on the event date.
III) If the DJ is required to start earlier than booked and the Client refuses to pay an extra time charge, the DJ shall only perform for the amount of time booked.
If the Client has agreed to cover additional expenses incurred by the DJ (such as taxi’s, food, hotel, flights etc.) DJ4Me will add this to the total balance remaining.
6. DJ4Me.ie Service Guarantee
I) We will use our reasonable endeavours to ensure that the Colm delivers a performance that is to the best of his ability. Colm will make every reasonable effort to – ensure that his performance is to the required standard, adhere to the client’s reasonable wishes, be polite and courteous to the Client, your guests and all venue staff and contractors.
II) DJ4Me shall provide all equipment required to undertake the performance. The adjustment of the volume and sound level of any equipment shall be as the Client reasonably requires.
7. DJ Equipment
It is agreed by the Client that the equipment of the DJ is not available for use by other performers, guests. Staff or persons except by specific permission and in the presence of the DJ4Me.
8. Withdrawal of Services
I) In case of verbal and/or physical violence towards the DJ or any person/person connected with DJ4Me, the Client may be asked to have this/these people removed from the venue. If an agreement regarding this cannot be resolved then the services of DJ4Me may be stopped, and the Client will be liable for the remainder of the Fee due plus any other costs or expenses incurred by DJ4Me as a result.
II) In the case of damage being caused to any equipment (either belonging to contracted to or leased to DJ4Me) by the Client or any person/person’s at the event the services of DJ4Me may be stopped, and the Client will be liable for the remainder of any Fee due. The Client will also be fully liable to reimburse DJ4Me for any damage to equipment (either belonging to, contracted to or leased to DJ4Me) within 7 days of the event date.
9. Venue and Electricity / General
Electricity - The Client undertakes the responsibility for ensuring that Dj4Me is given access to the venue and use of earthed mains electricity supply on their arrival. DJ4Me assumes the event venue meets the electrical safety standards to operate the Client’s selected package. In the event of any electrical risks being posed, DJ4Me has the discretion to reduce the size of the Client’s selected package in order to operate safely. The Client will continue to be liable for the agreed sum of the selected package.
Power Cuts - DJ4Me will not accept any liability for power cuts which interrupt the service provided, however, will endeavour to cooperate with the venue to try and rectify any problems. If reducing the equipment booked by the Client will overcome power supply problems at the venue then DJ4Me are given full authority to do so without consulting the Client. The Client understands that no compensation or price reduction will be given for power cut issues or for the reduction of equipment due to power supply problems.
Venue Restrictions - The Client will be responsible for checking and resolving any limits or restrictions attached to the venue, which could negatively impact on the ability of DJ4Me to carry out their services. This includes devices such as smoke alarms and sound limitation monitors.
Time required to install and take down equipment - The Client is responsible to ensure DJ4Me has sufficient time to set up and dismantle the rig/equipment based on the package booked. DJ4Me will not accept any liability for insufficient set up or dismantle time that results in either the booked package not being set up prior to the event or any additional charges for late exit of the venue. DJ4Me can provide an estimated setup and dismantle time for the Client to plan accordingly, but it generally takes between 45-60 mins to setup. Early setup (prior to guests arriving is also an optional extra that can be purchased).
Additional artists to perform alongside the DJ4Me - If the Client invites any additional artist(s) (independent of DJ4Me) to perform at their event, the Client must inform DJ4Me as to the identity of the artists and whether they require any technical requirements to execute their performance.
DJ4Me is not to be responsible for USBs/CDRs/Etc devices - The Client and/or their guests will be fully responsible for any USB or media devices given to DJ4Me and it is the responsibility of the Client and/or their guests to collect any USB or media devices after the given purpose is exhausted. The Client understands that any unclaimed USB or media devices following the event will be left at the venue. Furthermore, DJ4Me will not be responsible for any damage or distortion to the contents of the USB or media devices.
Recording - DJ4Me may use video and picture if agreed by the client for social media and promotional purposes. Written approval will be sought from the client prior to using.
10. Limitation of Liability
We disclaim any and all liability to you for the DJ services to the fullest extent permissible under applicable law. This does not affect your statutory rights as a consumer. If we are found liable for any loss or damage to you such liability is limited to the amount you have paid for the DJ service. We cannot accept any liability for any loss, damage or expense, including any direct or indirect loss such as loss of profits, to you howsoever arising. This limitation of liability does not apply to personal injury or death arising as a direct result of our negligence.
11. General Terms
The ‘Terms and Conditions’ together with payment and booking form constitute the entire agreement between you and us. No other terms whether expressed or implied shall form part of this contract. In the event of any conflict between these Terms and Conditions and any other term or provision on our website or elsewhere, these Terms and Conditions shall prevail.
If any term or condition of our contract shall be deemed invalid, illegal or unenforceable, the parties hereby agree that such term or condition shall be deemed to be deleted and the remainder of these Terms and Conditions shall continue in force without such term or condition.
These Terms and Conditions shall be governed by and construed in accordance with the laws of The Republic of Ireland. The parties hereto submit to the exclusive jurisdiction of the courts of The Republic of Ireland.
No delay or failure on our part to enforce our rights or remedies under these Terms and Conditions shall constitute a waiver on our part of such rights or remedies unless such waiver is confirmed in writing.
Terms used in this document shall have the following meanings:
“Booking Fee” means the fee as notified to you by us for the booking;
“Client”, “you”, “your” or “yours” means you, the person booking our services;
“Confirmation” means any verbal, electronic or written acceptance of the booking by DJ4Me;
“Terms and Conditions” means the terms and conditions upon which the booking for DJ services is made and which is set out in this document;
“DJ4Me.ie”, “DJ4Me”, “us”, ”our” or “we” means DJ4Me.ie by Colm Donnelly.
